County's entire hopes have been pinned on play-offs. The NL spent an entire fortnight consulting on this and hasn't even totally abandoned the idea now. Once you accept that there is no solution that would satisfy every one it would be about considering best endeavours and process not outcomes. As for Fylde, well anything that gets them relegated could in theory trigger legal action. But the history of null and void has been pretty well mapped. Seeking an injunction to void a season when it runs counter to common practice and has been exhaustively considered anyway, is a recipe for wasting money. Also despite chairman Dave's verbal explosions he is much more canny with his wallet. Doubt he'd go to court unless he was sure he could win. And in every instance where the solution would keep Fylde up that solution is more likely to result in others having a better case for an injunction then Fylde.

Lastly look at what's going on in Scotland in the SPFL. Threats, accusations, claims, counter claims, dossiers, rebuttals. Its almost like a street fight has broken out and part of the reason for that is that the courts have not really been involved at all so there's no legal process controlling things.
Anyone considering Legal Action will have to have deep pockets and a good degree of certainty of winnining.
Irrespective of what view you take I cannot see legal action going to court with costs associated.
It only takes one of the clubs to have legal insurance in place and hey ho off they go pulling everybody behind them. Or the situation where a club has a solicitor or barrister on its board who would be in a position to mount a case at a fraction of the cost.

Or of course, you do it the other way where you get as many clubs involved who all chip in which appears to be what the South Shields guy seems to be attempting to do.

Not if the club concerned got an injunction preventing the league from taking any decisions that could be seen as disadvantageous to the club that would mean if the league wished to carry on functioning it could only be done with the agreement of the injunction holder, for instance, dogfood Dave could agree to be relegated but only if the league agreed to underwrite the costs of the relegation for a season. And the minute that happened watch for the queues forming at the High Courts doors. Yes, there will be regulations in a leagues rules that say a club cant sue the league but good luck to them with trying to uphold that one.

It'll be a civil court action where the rules are different I doubt any club would win here

Well I suppose we need to wait and see. At least we will have progressed to the point that there is something to injunct!

Thought this was yesterdays subject. But to recap - the situation that now exists is one in which NO solution would not disadvantage SOMEONE. If you are going to seek to convince a court to injunct then you need to be able to demonstrate that in these circumstances the decision taken was unreasonable given the options available or that the process used to arrive at the decision was biased or flawed. Subject to no laws being broken and consultation having taken place that's a tough ask. Especially if the claim is between one mathematical approach to establishing places and another.

So in League 1 whether or not you apply a straight points solution, a PPG or a weighted PPG you end up with the same top 3 or bottom 3 albeit that goal difference is the only thing that separates then on some calculations.

In L2 a PPG or weighted PPG would see Swindon switch with Crewe as champions but both would be promoted. However a PPG or weighted PPG would see Cheltenham overtake Exeter to claim the 4th spot - that is if 4 go up. So that's where your challenge could come from. However the challenge would need to demonstrate why it was be more reasonable to finish "as is" than take into account that the team below had played a game less. Doesn't sound too strong to me.

Greg Clarke's comments today probably put the final nail in the coffin of void for the Premier League. Therefore the EFL and NL will follow suit. So all four will be aligned on this making that extremely tough to overcome. I expect they will all also go for the same "merited" calculation too. So that is what anybody challenging a decision will be faced with.

EFL regulations regarding promotion from the NL. I guess the top highlighted bit would help stop Notts trying legal means if the PL/EFL/NL all go the same way on PPG/Weighted PPG. It does say that the 2nd place team can go up without play offs.

10.1.3 Promotion and Relegation between League Two and The National League

(a) At the end of each Season the Champion club of The National League and The National League Runner Up (be that determined on the basis of League position alone or by way of play off competition) shall be eligible to apply for promotion to The League
, subject to:

(i) such clubs making application for membership of The League in accordance with Regulation 7 and receiving confirmation from The League (or, if applicable, the League Arbitration Panel) that the Club meets the criteria for promotion as set out in Regulations 7 and 8 and this Regulation 9.3;

(ii) The National League immediately accepting the retiring Clubs (pursuant to Regulation 7.7) as full members thereof; and

(iii) the format of the play-off competition (if any) operated by The National League having been approved by the Board in writing by the 30 June prior to the Season in which the play-off competition is to take place.

(b) If any of the foregoing conditions are not met by one or both of the clubs eligible to apply for promotion, the number of Clubs required to retire from League Two may, in the Board’s absolute discretion, be reduced accordingly and no other Clubs from The National League shall be eligible to join The League for the ensuing Season.

(c) Any Club admitted as a Member of The League in accordance with this Regulation 10.1.3 shall have until the 30 April next following their admittance as a Member Club to ensure that the ground at which they play their home games complies with the Admission Criteria set out at Appendix 1.

Aw shucks. No one will be nominated for any Booker prize award for the stuff that's written on here. It is largely gap filling, has been highly speculative for obvious reasons and quite understandably that pi**es a few people off. I probably enjoy it a bit too much too.

I do think the knocking about of thoughts and ideas has actually made our understanding of how things may play out perhaps a bit better than for some others and also be more able to tell when those apparently interested parties making a loud noise are actually saying something relevant.

Be nice to have some firm information to digest though.
